Web Design & Hosting Terms

1. Who these terms are between

These terms are between you (the business or person using our services) and Solomon Technology [legal entity name, state] (“we”, “us”). They cover our website design, development and hosting plans, the free homepage design offer, and template purchases. By submitting a form, booking a call, checking out, or using our services, you agree to them, along with our Privacy Policy.

2. The free homepage design

• We design one homepage concept from the details you give us, at no cost and with no obligation.
• If you don't want to go ahead, you pay nothing and owe us nothing.
• The design stays ours until you sign up for a plan. You may not use it, or have someone else build from it, without a plan.
• If you go ahead, the design becomes the starting point of your site under the hosting plan below.
• We aim to deliver within 48 hours of receiving your details. One offer per business.

3. Hosting plans and the 12-month term

• The Best Value plan is $500 per month. That price is guaranteed for your initial term.
• Plans have a 12-month minimum term, starting on the day your site launches. Billing is monthly, in advance, through Stripe.
• If you cancel before the 12 months are up, the remaining months of the term become due [or: an early-termination fee of $X].
• After the initial term, your plan continues month to month. Either of us can cancel with 30 days' written notice.
• Each plan includes the monthly service hours listed on its package. Work beyond those hours is billed at $50 an hour (one hour minimum), only after you approve it.
• If a payment fails and isn't fixed within [14] days, we may pause the site until it is.

4. Who owns what

• Your domain is yours. Your content (text, photos, logos you provide) stays yours.
• Once your initial term is complete and your account is paid up, the site's code is yours to keep if you cancel. Hosting it and making changes after that is on you, or whoever you hire.
• Third-party tools, themes, fonts and plugins stay under their own licences.

5. Custom and Flagship builds

Custom ($1,750) and Flagship ($3,000) builds are quoted and scheduled on a call. [Deposit, payment schedule, revision rounds and timeline to be set out in each build's proposal.]

6. Template purchases ($250)

• A template purchase is a one-time digital product: the template's code with the customisations you chose in our builder, and a hosting guide.
• It's delivered as is. It does not include hosting, further customisation, coding help, bug fixes in your own changes, or support beyond the included guide.
• It's licensed for one business's own website. You may not resell, redistribute or offer it as a template.
• Because it's a digital download, purchases are non-refundable once delivered [unless the files are faulty, in which case we'll replace them].
• Want us to host it or change it later? That's a hosting plan or billed hours, quoted separately.

7. Calls and texts (TCPA)

• If you tick the box to receive calls and texts, you agree that we may call or text the number you gave us about your design, your account and our services, including by automated means.
• That consent is optional and is never a condition of buying anything from us.
• Message frequency varies. Message and data rates may apply.
• Reply STOP to stop texts at any time, or HELP for help. You can also email [contact email].
• We record when you gave consent and the wording you agreed to.

8. Emails

If you give us your email, we'll send what you asked for and, occasionally, updates about our services. Every marketing email has an unsubscribe link.

9. Limits of our responsibility

We work hard to keep your site fast and online, but we can't promise it will never go down or that it will reach any particular search ranking or sales figure. To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the [3] months before it. [Indemnity and warranty language for legal review.]

10. Changes, law and contact

• We may update these terms. The version date is at the top; changes apply from the date they're posted, and we'll tell active clients about material changes.
